Using this Service/Program constitutes acceptance of the following terms and conditions:
I. This program is provided on an as is, as available service. NewPro Systems makes no warranties of any kind, either expressed or implied.
II. Under no circumstances, including negligence, shall NewPro Systems, or anyone else involved in creating, producing or distributing this Service, be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use this Service including, but not limited to, reliance on any information obtained through this Service; or that result from mistakes, omissions, interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation, or transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to NewPro Systems records, programs or services.
III. This Service may only be used for lawful purposes. Transmission of any material in violation of any International, US or State law is prohibited. This includes but is not limited to material legally judged to be threatening, obscene, or pornographic, or any material copy write protected or trade marked in any form.
IV. NewPro Systems reserves the right at its sole discretion to review, edit, or refuse to post any material or information. Not withstanding the foregoing, NewPro Systems will not intentionally disclose any private Email message unless permitted or required by law. NewPro Systems reserves the right to remove any content that it deems in its sole discretion to be unacceptable or undesirable.
V. USE OF OUR PROGRAM. The following actions may result in the immediate termination of your account without recourse and should NOT be done:
(a) sending unsolicited e-mail messages that contain ANY e-mail or web addresses from your account to
online users,
(b) posting messages that contain your addresses in Newsgroups that are unrelated to your product or service,
(c) forging your "From" Address in an e-mail message, or newsgroup posting, with your program addresses - giving the impression that the message or posting originated from the NewPro Systems network.
VI. Either you or NewPro Systems may terminate your account at any time. Your only right with respect to any dissatisfaction with any terms, rules, policies, guidelines, or practices of NewPro Systems in operating this program, any change in the contents of this program, or any change in the amount or type of fees charged in connection with this program, is to terminate your account by delivering notice to NewPro Systems, effective the day NewPro Systems receives notification of termination or any future date specified which is acceptable to NewPro Systems. NewPro Systems may terminate immediately any program user who misuses or fails to abide by this Agreement. NewPro Systems may terminate without notice your access to and use of this program upon a breach of this Agreement.
By signing up on the ENROLL form and submitting the form, you are acknowledging agreement to the entire contents of the above Representative Terms and Conditions of this program.
